However, it is prayed that appellant may be permitted to participate in auction to be conducted tomorrow for same work, on the basis of amount already deposited by appellant with respondent authorities. 2. Learned counsel for respondents submits that a sum of Rs.1,18,25,000/- was deposited by appellant, comprising Rs.50,00,000/- and Rs.68,25,000/-. Two cheques for said amounts had been issued to appellant; however, the same have not been encashed. E.M.D., as stipulated in tender notice dated 11.08.2026, is Rs.50,00,000/-. Appellant, it is stated, may HCJ & CGRJ WA_991_2026 therefore participate in auction proceedings on basis of E.M.D. already deposited by him and subject to compliance with conditions of tender. 3. Writ Appeal is accordingly dismissed as withdrawn, with liberty to appellant to participate in fresh auction pursuant to tender notice dated 11.08.2026, on basis of E.M.D. of Rs.50,00,000/- already deposited by him, subject to payment of any other charges that may be leviable and with due compliance with other terms and conditions of tender.
