JUSTICE R.K. PATTANAIK Order No. ORDER 17.02.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Bargarh P.S. Case No.373 of 2025 corresponding to Spl. C.T. Case No.46 of 2025 pending in the court of learned Sessions Judge, Bargarh on the grounds stated. 3. Perused the FIR as at Annexure-1. Learned counsel for the petitioner submits that the petitioner is similarly situated like the co-accused persons, who have been directed to surrender for being released on bail subject to conditions vide ABLAPL Nos. 9483, 10090 and 13293 of 2025. The submission is that the petitioner is involved on the basis of confessional statement of the co-accused persons. The submission is that even though, the petitioner is having other antecedents but is not directly involved and nothing has been seized from him and therefore, he should be granted pre-arrest bail, which is seriously opposed by learned counsel for the State on the ground that he is having seven other criminal cases of similar nature. Admittedly, the co-accused persons are on bail by the orders of this Court in ABLAPLs as at Flags- A, B and C. But, having regard to the fact that large scale contraband substance was recovered, this Court is not inclined to grant anticipatory bail to the petitioner, however, is of the view that he should be directed to be surrender before the court below and plead for bail like the co-accused persons. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned Sessions Judge, Bargarh in connection with Spl. C.T. Case No.46 of 2025, it shall be entertained and disposed of considering the plea of the petitioner as to having no direct involvement in the alleged recovery of contraband cough syrup bottles and that he is implicated on the basis of disclosure made by the co-accused person in all the criminal cases in which he is entangled. 6.
