Learned advocate for the petitioners submits that the petitioners are in custody for more than seven months and the quantum of recovery is 140 bottles of phensedyl. Learned advocate for the State opposes the prayer for bail and submits that witness action is about to commence. Having considered that 16 witnesses have been cited by the prosecution in order to prove its case, I am of the view that further detention of the present petitioners is unwarranted in the facts and circumstances of the case. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, Titon Mondal @ Titon Mandal and Golam Gous Khan shall be released on
2 bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act)-cum-Additional Sessions Judge, 5th Court at Berhampore, Murshidabad. If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned Special court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. Accordingly, CRM(NDPS) 390 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
