The petitioner is apprehending his arrest in connection with Deoghar Town P.S. Case No. 502 of 2025, registered for the offence under Sections 126(2), 115(2), 109(1), 351(4), 352 and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Deoghar. 3. Learned counsel appearing for the petitioner submits that the petitioner and informant are agnates and there are general and omnibus allegation of assault against all the accused persons. He further submits that the petitioner is having no criminal antecedent as disclosed in para 16 of the petition. He next submits that the petitioner is a student aged about 14 years. He also submits that other co-accused persons have been granted bail in A.B.A. No.786 of 2026. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State has opposed the prayer and submits that the allegation of assault is there. 5. Looking to the contents of the FIR, it transpires that the allegations of assault are there against co-accused Deepak Yadav, Sintu Yadav, Ajeet Kumar Yadav and Akash Kumar Yadav and in the aforesaid A.B.A., prayer of anticipatory bail of Akash Kumar Yadav has been rejected by this Court and three of the co-accused persons have been granted anticipatory bail and petitioner is said to be a student and the petitioner is having no criminal 2026:JHHC:13168 antecedent as disclosed in para 16 of the petition, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Deoghar, in connection with Deoghar Town P.S.
