2. The petitioner, namely, Surajit Dutta, has filed this application under Section 482 BNSS, 2023, with prayer for pre-arrest bail, as he is apprehending
Page No.# 2/3 arrest in connection with Jagiroad P.S. Case No. 73/2026, corresponding to G.R No.324/26, registered under Sections 318(4)/316(2)/ 316(3) /351(3) of BNS,
2023.
3. It is submitted at the Bar that the petitioner had taken a truck on hire from the complainant and thereafter, he had failed to pay the EMI. After failure of his payment of the EMI, the petitioner also failed to return the truck to the complainant.
4. It is submitted that meanwhile, the truck was seized by the Police and the complainant was given zimma of the truck vide order dated 18.05.2026, passed by the learned CJM. The petitioner could not produce a copy of the zimma order as the copy was not ready, when the petitioner had filed this application.
5. Learned Additional Public Prosecutor Mr. K.K. Das has submitted that there are incriminating materials in the Case Diary. This is not his first offence. The petitioner was earlier involved in such nefarious activities according to one witness.
6. I have also scrutinized the Case Diary. Indeed, there are incriminating materials in the Case Diary. I have considered the submissions that the petitioner has appeared before the Investigating Officer and his statement has been recorded. He has not violated any bail conditions. Thereby, the interim
order dated 26.05.2026 is made absolute under the same terms and conditions.
7. In terms of the above observation, this Anticipatory Bail application stands
disposed of.
