JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 22.06.2026 1. Heard learned Counsel Mr. S.Ali for the petitioners 1. Maznur Ali, 2. Zakir Ali @ Bhumi, 3. Chand Md. Ali @ Santu and 4. Kafiluddin Ali @ Raju who have filed this application under Section 483 of the BNSS, 2023 with prayer for bail as they are behind bars since 21.05.2026 in connection with Basistha PS Case No. 162/2026 under Sections 303 (2) of the BNS. 2. Mr. K.K.Parashar , learned Addl.Public Prosecutor is present for the respondent State. 3. The FIR unfolds that two heads of cattle were stolen from the informant's house and the petitioners are under investigation for theft of cattle. 4. It is submitted on behalf of the petitioners that co-accused has already been enlarged on bail by this Court in connection with Bail Application No. 1389/2026 vide order dated 27.05.2026. 5. I have considered the submissions that investigation may have presumably progressed. It is also submitted that the petitioners are local residents and they are willing to co-operate with the remaining part of the investigation. It appears that bail may be granted to the petitioners. 6. Considering the entire aspect of the matter, the petitioners named above shall be released on bail on furnishing bail bond of Rs.30,000/- each with a Page No.# 3/3 suitable surety of like amount to the satisfaction of the learned Illaqa Magistrate subject to the following conditions: i) That the petitioners shall refrain from such activities with which they are alleged, ii) That the petitioners shall appear before the I.O. till completion of investigation and iii) That the petitioners shall not leave the jurisdiction of the Court without prior permission. 7. On breach of any of the above conditions, the jurisdictional Court/ Illaqa Magistrate is at liberty to immediately cancel the bail granted to the petitioners. 8.
