By the present writ petition the petitioner seeks direction upon the respondent authorities, particularly, respondent no. 4, the District Inspector of School (P.E.), Paschim Medinipur to grant family pension in favour of the petitioner in terms of the Memo No. 96-SE(B)/1M-112/2008 dated 13th April, 2010. 3. The petitioner contends that her father, namely, Shibaram Adhikary was an Assistant Teacher in Durga Temple No. 1 G.S.F. Primary School, Kharagpur, Dist. Paschim Medinipur who retired on 28th February, 1995 on superannuation. The Pension Payment Order was issued in favour of the father of the petitioner on 24th January, 1998. The father of the petitioner died on 5th May, 2018. The mother of the petitioner died on 25th December, 2022. The petitioner is the unmarried daughter of the deceased employee. On 25th September, 2025, the petitioner made a representation before respondent no. 4, the District Inspector of School (P.E.), Paschim Medinipur as well as other authorities for grant of family pension. However, the same is still pending consideration before the authorities. Hence this writ petition. 4. Mr. Sudipta Maiti, learned advocate for the petitioner submits that the unmarried daughter is entitled to family pension. He seeks the matter be relegated to the appropriate authorities to consider and dispose of the representation of the petitioner dated 25th September, 2025 (annexure P-5). 5. Ms. Rupsha Chakraborty, learned advocate for the State also submits that the matter be sent to the appropriate authority for due consideration. 6. In view of such submissions, respondent no.4, District Inspector of Schools (P.E.), Paschim Medinipur, is directed to consider the representation of the petitioner dated 25th September, 2025 and dispose of the same in accordance with law upon notice to the petitioner by passing a reasoned order within a period of eight weeks from the date of communication of this order. 2 7. The reasoned order shall be communicated to the petitioner within a period of one week from the date of passing of such order. 8. Learned advocate appearing for the petitioner is directed to communicate this order to respondent no.4, District Inspector of Schools (P.E.), Paschim Medinipur, for necessary compliance. 9. With the aforesaid directions, the writ petition being WPA 27910 of 2025 is disposed of. 10. Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied. 11. There shall be no order as to costs. 12. Interim order, if any, stands vacated. 13. Connected applications, if any, stand disposed of. 14. Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
