For Petitioners : Mr.D.Akaash For Respondents : Mr.D.Ravichander Special Government Pleader [R1 & R2] Notice dispensed with [R3] ***** ORDER This Writ Petition has been filed seeking protection for the petitioners’ interest over the property before completing the survey and demarcation of boundaries by the 2nd respondent in compliance with the directions issued by this Court on 28.01.2026 in W.P.No.2146 of 2026. 2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 and 2. Since no adverse order is passed against the 3rd respondent in this writ petition, notice to the 3rd respondent is dispensed with by this Court. 3. The petitioners contend before this Court that the 3rd respondent does not have any legal right to seek survey and demarcation of boundaries of the property. They also contend that a preliminary decree Page No.2 of 9 https://www.mhc.tn.gov.in/judis W.P.No.14701 of 2026 has already been passed, under which, the 3rd respondent does not have any legal right over the property. According to the petitioners, the 3rd respondent has obtained orders from this Court on 28.01.2026 in W.P.No.2146 of 2026 directing the 2nd respondent to survey and demarcate the boundaries. As seen from the aforesaid order, dated 28.01.2026 passed in W.P.No.2146 of 2026, the interest of the petitioners is protected by permitting the petitioners and other objectors to raise all objections before the 2nd respondent with regard to survey and demarcation of boundaries conducted by the 2nd respondent pursuant to the orders passed by this Court on 28.01.2026 in W.P.No.2146 of 2026. The petitioners contend that though their objections were recorded by the 2nd respondent, the 2nd respondent ignored the same and is proceeding with the survey and demarcation of boundaries of the property. 4. Learned Special Government Pleader appearing for the respondentts 1 and 2 has also placed on record the written instructions received by him from the 2nd respondent, dated 15.04.2026. As seen from the same, the objections raised by the petitioners in this writ petition have been duly considered by the 2nd respondent. However, as on date, no Page No.3 of 9 https://www.mhc.tn.gov.in/judis W.P.No.14701 of 2026 survey report has been submitted by the 2nd respondent pursuant to the directions issued by this Court on 28.01.2026 in W.P.No.2146 of 2026. 5. Learned counsel for the petitioners, on instructions, would submit that survey and demarcation of boundaries by the 2nd respondent is due to take place tomorrow (17.04.2026). He also submits that the petitioners apprehend that the 3rd respondent may put-up a fencing after completion of the survey and demarcation of boundaries by the 2nd respondent, which will be detrimental to the petitioners’ interest and will be contrary to the preliminary decree passed by the civil court in favour of the petitioners. 6. This Court is not expressing any opinion on the merits of the respective contentions. 7. If the petitioners are aggrieved by the survey report to be submitted by the 2nd respondent, the petitioners will have to challenge the same in a manner known to the petitioners under law. At this stage, when the interest of the petitioners has been duly protected through an order, Page No.4 of 9 https://www.mhc.tn.gov.in/judis W.P.No.14701 of 2026 dated 28.01.2026 passed in W.P.No.2146 of 2026 by directing the 2nd respondent to consider the objections of the petitioners, the question of interfering with the survey and demarcation of boundaries by the 2nd respondent, who is complying with the directions of this Court, vide order, dated 28.01.2026 passed in W.P.No.2146 of 2026 does not arise. Prematurely, this writ petition has been filed by the petitioners. If aggrieved by the survey report to be submitted by the 2nd respondent pursuant to the directions issued by this Court on 28.01.2026 passed in W.P.No.2146 of 2026, the petitioners will have to challenge the same in the manner known to the petitioners under law by a separate legal proceedings. If at all the petitioners are aggrieved by the 3rd respondent’s conduct of attempt to put-up fencing over the demarcated property, the petitioners, at this stage, can very well approach the civil court in the pending suits in which the petitioners claim that they are having the benefit of a preliminary decree. 8. For the foregoing reasons, since this writ petition has been prematurely filed and since the interest of the petitioners have been adequately protected through the order, dated 28.01.2026 passed in Page No.5 of 9 https://www.mhc.tn.gov.in/judis W.P.No.14701 of 2026 W.P.No.2146 of 2026, this Writ Petition is disposed of by directing the 2nd respondent to furnish a copy of the survey report to the petitioners pursuant to the completion of survey and demarcation of boundaries conducted by the 2nd respondent in terms of the directions issued by this Court on 28.01.2026 passed in W.P.No.2146 of 2026, withn a period of one (1) week from the date of receipt of a copy of this order. On receipt of the same, the petitioners are granted liberty to approach this Court once again by filing a separate writ petition or any other legal proceedings in the manner known to the petitioners under law. If aggrieved by the survey report submitted by the 2nd respondent, the petitioners are also granted liberty to approach the civil court for seeking protection with regard to the fencing of the property by the 3rd respondent pursuant to the survey and demarcation of boundaries by the 2nd respondent in terms of the directions issued by this Court on 28.01.2026 in W.P.No.2146 of 2026.
