2/07.01.2026 Heard learned counsel appearing on behalf of Petitioner and
learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in Hirodih P.S. Case No.95 of 2025, registered for the offence punishable under Section 303(2), 317(2), 317(5) & 3(5) of the Bhartiya Nyaya Sanhita, 2023; and under Rule 13 of Jharkhand Minerals Rules, 2017, pending in the court of learned Judicial Magistrate First Class, Giridih.

Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of illegally running the stone crusher plant. She next submits that the petitioner is not having any crusher plant as disclosed in Para-8 of the petition and the petitioner is earning his livelihood by way of doing the labour work and this fact has been stated in para-16 of the petition. She also submits that the petitioner has got no criminal antecedent as disclosed in Para 17 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of illegally running of the stone crusher plant.

Considering that in para-8, it has been stated that the petitioner is not the owner of the crusher plant and in para-16 it has been stated that the petitioner is earning his livelihood by way of doing labour work and the petitioner has got no criminal antecedent as disclosed in Para-17 of the petition, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court within four weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate First Class, Giridih, in connection with Hirodih P.S. Case No. 95 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
6. This Anticipatory Bail Application is accordingly allowed and
disposed of.
