The petitioner is apprehending his arrest in connection with Muffasil P.S. No.60 of 2025, for offence registered under sections 103(1), 108, 3(5) of BNS, 2023, pending in court of learned S.D.J.M., Sahibganj. 3. Learned counsel for petitioner submits that the deceased was having suspicion against the petitioner that the petitioner was having illicit relationship with the husband of the deceased. He further submits that at the time of marriage of the deceased along with the brother-in-law of this petitioner, she was four months pregnant and at the time of alleged suicide made by the deceased, she was seven months pregnant and now the petitioner has given birth to a girl child on 17.8.2025 at Primary Health Centre at Bhagalpur, Bihar and Birth certificate is annexed as Annexure-2. He next submits that the petitioner happened to be elder sister-in-law of the deceased. 2026:JHHC:813 2 4. Learned State counsel opposes prayer and submits that the deceased has made suicide due to relationship of the petitioner along with the husband of the deceased. 5. Prima facie, it appears that apprehension is there of relationship between the petitioner and the husband of the deceased, however, at the time of marriage itself, the petitioner was pregnant by four months and at the time of suicide she was pregnant of seven months and she has been blessed with a girl child on 17.08.2025 and it is fortified in light of the Annexure-2 which is the Birth Certificate, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M., Sahibganj, in connection with Muffasil P.S. No.60 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 13.01.2026 SI/
