No.12958 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India, to issue order or orders, direction or directions, writ, particularly one in the nature writ of Mandamus, or any appropriate writ, declaring the action of the respondents in not paying the admitted bill amounts payable to the petitioner vide agreement No. 12 / 2018 - 19 dated 12.11.2018 for renovation of inspection pan on RB of Vissakoderu Channel in between Km. 1.200 to 2.000 in Vissakoderu Village limits in the jurisdiction of W.U.A., Taderu for the year 2018 - 19 for the total amount payable of Rs. 8,09,453/- as illegal, arbitrary and in violation of Articles 14, 19 (i) (g), 21 and 300- A of the Constitution of India and consequently, direct the respondents to release the bills for the subject completed works immediately with 6% interest as held by the Divisional Bench of the High Court of Andhra Pradesh vide W.A. No. 724 / 2021; and to pass such other order as this Court deems fit and proper. 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 03. On the other hand, learned Assistant Government Pleader for Irrigation, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the Executive Engineer (F.A.C.), Godavari Western Division, Nidadavolu, vide Letter No. AB / A1 / WP No. 12958 of 2026, dated 18.08.2026 stating that the net amount of Rs. 7,07,534/- could not be uploaded 3 W.P. No.12958 of 2026 in NIDHI portal due to lack of funds. He further submitted that the petitioner is not entitled to claim interest as per the terms and conditions in the agreement. 04. In view of the submissions made on both sides, the writ petition is disposed of, directing the respondents to release the admitted amount of Rs. 7,07,534/- (seven lakh seven thousand five hundred thirty four rupees only) to the petitioner, along with the interest as per the entitlement, if any, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. There shall be no order as to costs.
