The petitioner is apprehending his arrest in connection with Herhanj P.S. Case No.13 of 2025, registered for the offence under Sections 17, 18 and 29 of N.D.P.S. Act, pending in the Court of the learned Special Judge, N.D.P.S., Latehar. 3. Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the cultivation of the poppy plants. He further submits that false allegations are made of cultivation of poppy plants on the forest land. He next submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 16 of this application. He also submits that three of the co-accused have been granted anticipatory bail by this Court in A.B.A. No.5302 of 2025. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plants on the forest land. 5. Considering that the land is of the Forest Department and the petitioner is having no criminal antecedent, as disclosed in paragraph 16 of ( 2026:JHHC:6772 ) -2- A.B.A. No. 1296 of 2026 this application and in identical situation, three of the co-accused has been granted anticipatory bail by this Court in the aforesaid A.B.A. and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
