Saddam Hussain … … Petitioner(s) Mr. Navanil De Mr. Srinjan Ghosh … for the Petitioner(s) Mr. Avishek Sinha Ms. Suruchi Saha … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for about seven month and has been implicated for alleged recovery of 50 bottles of phensedyl, Charge-sheet has already been submitted according to the learned advocate, as such, further detention of the present petitioner is unwarranted. Learned advocate for the State opposes the prayer for bail and submits that charges have been framed and witness action will commence on and from the next date. The records of the case reflect that prosecution has cited 13 witnesses in the charge-sheet, as such, there is no possibility of the trial concluding in the near future. 2 Having considered the same, I am of the view that further detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Saddam Hussain @ Md. Saddam Hussain shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under (NDPS Act), in charge, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned Special court and shall not leave the jurisdiction of the district of Uttar Dinajpur without prior permission of the learned Special Court.
