PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: These two Criminal Petitions are heard together and are being disposed of by this common order, as the Petitioners in the two Petitions are different, but the crime registered against them is one and the same. 2. Criminal Petition No.7332 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1 and 2 on bail in Crime No.55 of 2026 of Tsundupalli Police Station, YSR Kadapa District, was registered for the alleged offences punishable under Sections 126(2), 308(2) and 109(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 3 Dr.YLR, J Crl.P.Nos.7332 and 7333 of 2026 Dated 25.06.2026 3. Criminal Petition No.7333 of 2026 has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.55 of 2026 of Tsundupalli Police Station, YSR Kadapa District, was registered for the alleged offences punishable under Sections 126(2), 308(2) and 109(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 4. Smt. Sudeepthi Potluri, the learned counsel for the Petitioners, submits that the Petitioners are innocent of the alleged offence and have been falsely implicated by the Police. The Petitioners undertake to strictly adhere to any conditions that may be imposed by this Court. Hence, it is urged to allow the Criminal Petitions. 5. Per contra, Mr.A.Sai Rohith, the learned Assistant Public Prosecutor, vehemently opposed the grant of anticipatory bail to the Petitioners, submitting that the investigation is still at a nascent stage and several material witnesses remain to be examined. It is further urged that if the Petitioners are granted anticipatory bail, there is a strong likelihood of their absconding and evading the process of law. Hence, it is urged to dismiss the Criminal Petitions. 6. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 7. On perusal of the record, the de-facto complainant alleged that the Accused Nos.1 and 2 attacked him with a sickle and caused grievous injuries. 4 Dr.YLR, J Crl.P.Nos.7332 and 7333 of 2026 Dated 25.06.2026 The wound certificate is not yet received to know the nature of the injuries. Therefore, this Court is not inclined to grant bail to the Petitioners/Accused Nos.1 and 2 at this point of time in view of the pendency of the investigation. Hence, the petition against the Petitioners/Accused Nos.1 and 2 in Crl.P.No.7332 of 2026 is dismissed. 8. Having regard to the facts and circumstances of the case, the nature of the allegations levelled against the Petitioner/Accused No.3 in Crl.P.No.7333 of 2026 is concerned, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.3, with some stringent conditions. 9. In the result, the Criminal Petition No.7333 of 2026 is allowed with the following conditions: i. In the event of her arrest, the Petitioner/Accused No.3 shall be enlarged on bail subject to her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.3 shall make herself available for investigation as and when required; iii. The Petitioner/Accused No.3 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the Charge Sheet. iv. The Petitioner/Accused No.3 shall not leave the limits of the Andhra Pradesh without the express permission from the Station House Officer concerned. 5 Dr.YLR, J Crl.P.Nos.7332 and 7333 of 2026 Dated 25.06.2026 v. The Petitioner/Accused No.3 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. vi. The Petitioner/Accused No.3 shall surrender her passport, if any, to the Investigating Officer.
