The present appeal has been filed under Section 173(1) of the Motor Vehicles Act, 1988, seeking to challenge Judgment and Award dated 30.05.2018 in MVC No.1185/2012 passed by the Senior Civil Judge and MACT, Turuvekere. HC-KAR NC: 2026:KHC:11022 MFA No. 7800 of 2018 - 3 - 2. By the impugned award a compensation of Rs.3,54,000/- was granted along with interest at the rate of 6% per annum. 3. The record reflects that during the pendency of this appeal the appellant was directed to file translated copies of the documents which are in vernacular. For this purpose the matter was adjourned on 22.08.2025 as well as on 24.09.2025. Thereafter, this Court had on 19.01.2026 has observed the following. “1. The orders dated 22.08.2025 and 24.09.2025 have not been complied with by the appellant. The final opportunity is granted to comply with the same within 3 days, failing which the appeal will be dismissed for non-prosecution. 2. List on 29.01.2026.” 4. This order was reiterated on 29.01.2026. Despite the lapse of more than 8 months, since these directions were passed by this Court, no compliance of the same has been made. Even though the same translations were stated to be filed, these have not been validly attested. HC-KAR NC: 2026:KHC:11022 MFA No. 7800 of 2018 - 4 - 5. It is clear that the appellant does not wish to prosecute the matter. The appeal is accordingly dismissed for non-prosecution.
