S. No. 86 Suppl Cause List-1 IN THE HIGH COURT 0F JAMMU & KASHMIR AND LADAKH AT SRINAGAR CRM(M) 242/2026 GULZAR AHMAD SHAKSAZ …Appellant(s)/Petitioner(s) Through: Mr. Mir Umar, Advocate and Ms. Sabiya Hilal, Advocate Vs. ABDUL BARI NAIK AND ANOTHER ...Respondent(s) Through: CORAM: HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER 24.04.2026 Learned counsel for the petitioner claims that the complainant- petitioner has already filed a petition under Section 175(3) BNSS seeking a direction upon SHO Police Station, Pattan for lodging FIR against respondents and that learned Magistrate despite being persuaded to take urgent steps for registration of FIR, but the complaint is pending, as a result, there is every likelihood that recovery of evidence may diminish. It is further submitted that the learned Magistrate had directed the SHO police concerned to send the report, even too that has been received, but still no final orders have been passed. Given the nature of prayer asked for, this petition is disposed of with a direction to the learned Magistrate to expeditiously dispose of the petition filed under Section 175(3) BNSS, having regard to the urgency expressed at bar. Copy of this order shall be convey to the learned Magistrate.
