This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants arrested in connection with Crime No. 53/2025 registered at Police Station – City Kotwali, District – Bilaspur (C.G.) for the offence punishable under Section 109(1) of the BNS.
2. Case of the prosecution, in brief, is that In brief, on 26.01.2025 at about 15:30 hours, the accused, Raja Ahirwar, was engaged in a quarrel with his wife, Priyanka Ahirwar. When the complainant/injured intervened and objected to the accused quarreling with his wife, the accused responded by saying that it was none of her concern and that he was quarreling with his own wife. 2 complainant/injured and, with the intention to commit murder, inflicted blows with a knife on her chest and abdomen. It is alleged that, had the complainant/injured not defended herself, she would have been certainly killed by the accused. Upon intervention by family members who rescued her, the incident was reported, and on the basis thereof, a Dehati Nalishi was registered by Police Station City Kotwali, whereupon a criminal case was formally registered and taken up for investigation. Hence, this application.

Learned counsel appearing for the applicants submits that the applicants are innocent and has been falsely implicated in the present case. It is submitted that the applicants are in jail since 28.01.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail.

On the other hand, learned State counsel, opposes the bail application and submits that the applicant is said to have assaulted the injured with knife on his chest and abdomen, due to which he sustained injuries, and as per the MLC Report and the doctor’s opinion, the injuries are grievous in nature and dangerous to life. As such, the bail application deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant is said to have assaulted the injured with knife on his chest and abdomen, due to
3 which he sustained injuries, and as per the MLC Report and the doctor’s opinion, the injuries are grievous in nature and dangerous to life, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail.
7. Accordingly, this bail application of applicant – Raja Ahirwar involved in Crime No. 53/2025 registered at Police Station – City Kotwali, District – Bilaspur (C.G.) for the offence punishable under Section 109(1) of the BNS, is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
