THIS PETITION, COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE MOHAMMAD NAWAZ ORAL ORDER 1. The prayer in this petition is to direct the trial Court to conclude the trial in C.C. No.874/2021 expeditiously and within a period of six months. 2. The learned counsel for the petitioner would submit that charge sheet was filed against accused Nos.1 and 2, wherein the petitioner is arraigned as accused No.2. Accused No.1 has been discharged and now the petitioner is the lone accused facing trial. The alleged incident is of the year 2019 and charge sheet was filed on 19.11.2020, however charges were framed on 11.06.2025. He submitted that the petitioner was an employee of the State Bank of India and on false accusation against him, he has been arraigned as an accused. He is dismissed from service in view of registration of a false case and now he is aged about - 3 - HC-KAR NC: 2026:KHC:8996 CRL.P No. 1229 of 2026 57 years. Hence, he submitted that if the trial is prolonged, then his entire career will be ruined. 3. FIR is registered against accused Nos.1 and 2 in Crime No.89/2019 of Javagal Police Station for the offence punishable under Sections 409 and 420 of IPC on a complaint lodged by the Manager of the State Bank of India, Javagal branch, Arasikere taluk, Hassan district. FIR was registered on 02.08.2019. Investigation resulted in filing of charge sheet against both accused Nos.1 and 2 under Sections 409 and 420 read with Section 34 of IPC. Accused No.1 has been discharged by the Sessions Court. 4. The learned counsel for the petitioner is not seeking any verdict on merits of the case. His prayer is to direct the trial Court to conclude the trial in an expeditious manner. 5. It is seen that charge sheet was filed in the year 2020, whereas the charge was framed on 11.06.2025 as submitted by the learned counsel. Though this Court cannot direct the trial Court to conclude the trial in a time bound - 4 - HC-KAR NC: 2026:KHC:8996 CRL.P No. 1229 of 2026 manner, which direction may be difficult to be complied, however, considering that the alleged incident is of the year 2019 and 6 years have been elapsed, the learned II Additional Civil Judge (Junior Division) and JMFC, Arasikere, Hassan, is directed to make an endeavour to conclude the trial in Criminal Case No.874/2021 expeditiously subject to co-operation by the accused.
