Heard the learned counsel appearing for the respective parties.
The petitioner is an accused in connection with Sahibganj (M) PS Case No. 73/2024.
It has been alleged that the petitioner along with the co-accused had abducted the daughter of the informant, committed rape upon her and after solemnizing marriage had taken her to Surat and after four months, she was brought back to her place with a threat not to disclose about the incident to anyone.
Submission has been advanced by the learned counsel for the petitioner that the petitioner had solemnized marriage with the victim and in fact, the victim is at present residing in the house of the petitioner. It has been submitted that the petitioner is in custody since 20.01.2025.
Learned counsel for the informant has supported the fact that the matter has been compromised and the informant is ready and willing to reside with the petitioner and the informant, in fact, is residing in the house of the petitioner.
The evidence of the victim has been brought on record and she in her evidence as PW-3 has stated in her cross-examination that the petitioner had forcibly solemnized marriage with her. It further appears that out of 13 charge- sheeted witnesses, 9 witnesses have been examined. The informant was a minor at the time of the incident.
In such circumstances, I am not inclined to grant bail to the petitioner and the same is accordingly rejected at this stage.
