Rakib CRM (NDPS) 1359 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NDPS Case no. 14 of 2023, NCB Crime No. 14/NCB/KOL/2023 under Sections 8(c)/22(c)/29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of : Shankar Yadav @ Uma Shankar Yadav ……Petitioner. Mr. Rajeev Lochan ……for the Petitioner. Mr. Krishnendu Bhattacharya Mr. Atanu Basu Mr. Indranuj Dutta ……for the NCB. Learned advocate appearing for the petitioner submits that the petitioner is falsely implicated in connection with the instant case and in is custody for two years six months. Learned advocate for the NCB on the other hand opposes the prayer for bail and submits that out of nine witnesses proposed to be examined by the prosecution six witnesses have already been completed. The examination-in-chief of PW7 is over and cross- examination of PW7 is in progress and two other witnesses are to be examined. Having regard to the stage of the case, I am of the opinion that at this belated stage, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1359 of 2025 is dismissed. 2 Report so submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
