The petitioner is apprehending his arrest in connection with Chandwa P.S. Case No.42 of 2025, for offence registered under section 18 of the NDPS Act, pending in court of learned Special Judge (NDPS) Latehar. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and false allegations are made of cultivation of poppy plants. He next submits that even the land is not belonging to the petitioner and the petitioner has got no criminal antecedent as disclosed in paragraph no.15 of the petition. He also submits that the co-accused persons have been granted anticipatory bail in ABA Nos.5070 of 2025, 5977 of 2025, 5068 of 2025 and 4381 of 2025. 4. Learned State counsel opposes prayer and submits that the allegations are there of cultivation of poppy plant on the forest land. 5. Considering that the land is not belonging to the petitioner and the petitioner has denied cultivation on the alleged land and in identical case, co-accused persons have been granted anticipatory bail as aforesaid, and the petitioner is having no criminal antecedent as disclosed aforesaid, and in that view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
