The instant bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the impugned FIR No. 47/2026 registered with the Police Station Bhalta District Jhalawar for the offences punishable under Section(s) 8/21, 25, 29 of NDPS Act in which charge-sheet has been submitted under Section(s) 8/21, 25 and 29 of NDPS Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case solely on the statement of co-accused Ramesh and Roshan from whose possession contraband articles has been recovered and they have already been enlarged on bail. Learned counsel further submits that the charge-sheet has already been filed; that there is no criminal antecedents registered against the accused-petitioner. Learned counsel submits that the accused-petitioner has been in [2026:RJ-JP:22973] (2 of 3) [CRLMB-8291/2026] custody since long and the trial will take its own time to conclude, therefore, indulgence of bail may be granted to the petitioner. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application but concurs with the fact that there are no criminal antecedents against the accused-petitioner. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. Having considered the submissions advanced by learned counsel for the petitioner, and taking into account the fact that the accused petitioner has been implicated in this case solely on the basis of statement of co-accused Ramesh and Roshan from whose possession contraband articles has been recovered and they have already been enlarged on bail by co-ordinate Bench of this court vide order dated 09.03.2026 passed in SB criminal misc. bail application No. 3678/2026. Learned counsel further submits that the charge-sheet has already been filed; that there is no criminal antecedents registered against the accused-petitioner. Learned counsel submits that the accused-petitioner has been arrested on 04.05.2026 and the trial will take considerable time for its conclusion. Hence, this Court, without expressing any opinion on the merits or demerits of the case, considers it just and proper to extend the benefit of bail to the accused-petitioner under Section 483 of the BNSS 6. Accordingly, the instant bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Ramlal S/o Prabhulal, arrested in connection with the aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- along with two surety [2026:RJ-JP:22973] (3 of 3) [CRLMB-8291/2026] bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all the dates of hearing, as and when called upon to do so. 7. It is made clear that the accused-petitioner shall not involve in any offence(s) during currency of the bail. In case of breach of the condition, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. 9.
