Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toissue an appropriate Writ, more particularly a Writ of Mandamus, declaring the action of Respondent Nos.1 to 4 police authorities in interfering with the life, liberty, dignity, privacy and peaceful residence of the Petitioner, wife of A3-Bogineni Lakshmana Rao in Crime No.196/2026 dated 10.08.2026 of Kanchikacherla Police Station, though she is not an accused, and in pressurizing her and her family to settle the alleged monetary claims of Respondent No.5 / defacto complainant including by utilizing or transferring ancestral/family property, as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the Respondent police to conduct the investigation fairly and strictly in accordance with law and due process IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct Respondent Nos.2 to 4 police authorities not to interfere with the life, liberty, dignity, privacy and peaceful residence of the Petitioner; not to harass, intimidate or coerce her in connection with Crime No.196/2026; not to compel her, her Husband(A3) or their family members to settle the alleged monetary claim; not to compel or facilitate transfer/alienation/utilization of ancestral/ family property; and not to facilitate or support the entry of the 5th Respondent or his representatives into the Petitioner's residential premises at Vijayawada for the purpose of compelling settlement, except by following due process of law. in the interest of justice Counsel for the Petitioner:

ORDER:
Heard learned counsel for the petitioner. Learned Assistant Government Pleader for Home takes notice on behalf of respondent Nos.1 to 4.

Learned counsel for the petitioner would submit that husband of the petitioner is arrayed as accused No.3. in crime No.1962026 for the offences punishable under Sections 316 (5), 318 (4) r/w 3(5) of BNS, petitioner is no way concerned with the allegations leveled in the report given by the respondent No.2, however, the 4th respondent police has been harassing her, pressurizing her and her family to settle the alleged monetary claims of the respondent No.5 trying to transfer her property and requested to issue suitable direction to the respondent No.4.

Learned Assistant Government Pleader submitted that the investigating officer would follow the procedure in accordance with law and if necessary, will issue notice under Section 35(3) or record the statement of the petitioner and while disposing this petition can give instructions in that regard.
4. Admittedly, no criminal case is registered against the petitioner and her husband is arrayed as accused in Crime No.196/26. So, it is needless to say that the respondent No.4 shall invariably proceed in accordance with law to conduct investigation and so far, he has no right to call the petitioner to the police station or to pressurize her to settle the matter as she is no way concerned with the case.

Learned counsel for the petitioner and learned Assistant Government Pleader fairly conceded to dispose of this writ petition by giving such directions to the respondent No.4.

6. Therefore, this writ petition is disposed of, and the respondent No.4 is
directed to proceed in accordance with the provisions of BNS so as to conduct investigation in Crime No.196/26 and shall not call the petitioner to the police station, except under due process of law. There shall be no order as to costs.
As a sequel thereto, pending miscellaneous petitions, if any, shall stand closed. ________________________ SUNITHA GANDHAM, J
