P.P. …...... 04/ 20.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 64, 351(2) & 351(3) of BNS and Sections 4 & 6 of the POCSO Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned AddI. P.P. opposes the prayer for bail. 4. There is allegation against this petitioner has committed rape upon the minor daughter of the informant aged about 16 years. The statement of the victim under Section 183 of BNSS has been recorded and the same has been placed before this Court. From paragraph 3 of the said statement, I find that she supports the prosecution case and stated that this petitioner has raped her. 5. Considering the aforesaid fact and materials available on record, at this stage, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Boarijore P.S. Case No.43 of 2025, pending in the Court of learned Special Judge (POCSO), Godda, stands rejected. 6.
