1. Heard Mr. Din Dayal Saha, learned counsel for the appellant and learned A.P.P.
2. This appeal is directed against the order dated 26.11.2025 passed in A.B.P. No.483 of 2025 by learned Sessions Judge, Pakur arising out of Pakur Town P.S. (Malpahari O.P.) Case No.182 of 2025, whereby and whereunder the prayer for anticipatory bail of the appellant has been rejected.
3. It has been alleged that on a secret information, a motorcycle with two persons were intercepted but the said persons managed to flee away and on search of the sacks which were in the motorcycle, 1148 pieces of gelatin sticks were recovered and seized.
4. Submission has been advanced by learned counsel for the appellant that the police has failed to ascertain that the appellant was one of the persons who was in the motorcycle and who had fled away at the time of the raid. It has been submitted that the appellant has an explosive license which has been renewed up to 31.03.2026 and therefore, it would seem improbable about the appellant supplying gelatins on a motorcycle.

5. Learned A.P.P. has opposed the prayer for anticipatory bail of the appellant and has submitted that the name of the appellant being one of the riders of the motorcycle, has come on the basis of the secret information.

In view of the manner of implication of the appellant and the fact that the appellant is an explosive licensee for which documents have also been brought on record, we while setting aside the order dated 26.11.2025 passed in A.B.P. No.483 of 2025 by learned Sessions Judge, Pakur arising out of Pakur Town P.S. (Malpahari O.P.) Case No.182 of 2025, direct the appellant to surrender before the learned Trial Court within a period of four weeks and on his surrender, the learned Court below shall release him on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of Learned S.D.J.M., Pakur in connection with Pakur Town P.S. (Malpahari O.P.) Case No.182 of 2025.
7. Accordingly, this appeal is allowed.
