It is the contention of the petitioner that when he was serving in the Indian Army, the petitioner had earlier filed an application in the year 1996 seeking grant of agricultural lands under the provisions of the Karnataka Land Grant Rules. However, now that the petitioner has retired from service and - 3 - HC-KAR NC: 2026:KHC:14179 WP No. 6257 of 2026 being an ex-serviceman and having regard to the amendment brought to the Karnataka Land Grant Rules, 1969, more particularly, Rule 8 which requires the ex-serviceman to file an application in Form No.1A as prescribed, the petitioner has filed an application on 21.06.2025. Learned counsel for the petitioner submits that in the representation at Annexure-H dated 21.06.2025, filed along with the application in Form No.1A, the petitioner has stated that the lands granted in favour of one Smt. Seethalakshmi Venkatsubbaiah in the year 2007 should be cancelled and the said lands should be re- allotted to the petitioner. However, the petitioner does not press the said statement made in the representation. The petitioner is only seeking necessary directions to be issued to the respondent-Deputy Commissioner, Bangalore South District, to pass necessary orders for the grant of land having regard to the application filed by the petitioner. 3. Consequently, the writ petition stands disposed of with a direction to respondent No.2-Deputy Commissioner, Bangalore South District, and respondent No.5-Tahsildar, Harohalli Taluk, to consider the application given by the petitioner and pass necessary orders as expeditiously as - 4 - HC-KAR NC: 2026:KHC:14179 WP No. 6257 of 2026 possible and at any rate within a period of two months from the date of receipt of a copy of this order. Needless to observe that if the lands are not available for grant, then in terms of the notification issued by the Revenue Department of the State Government, a residential site may be offered to the petitioner.
