1. On execution of bailable warrant, non-applicant – Rushikesh s/o Naresh Siramwar, is personally present before this Court. 2. Heard the learned counsel appearing for the respective parties. 3. By the present application, prosecution putforth following prayer clause (i): (i) allow the application, thereby cancelling the bail granted by this Court to the Non-applicant in criminal application No. 881/2024. It’s already on 17.10.2024 in crime number 383/2024 registered with the applicant police station for the offences punishable under sections 69, 78, 79, 296, 351, 352, 115, 356 of Bharatiya Nyaya Sanhita, 2023 (Annexure A-2)
4. Learned APP submits that, by order dated 17/10/2024 passed in Criminal Application (BA) No.881 of 2024, this Court enlarged non-applicant No.1/accused on bail in connection with Crime No.383 of 2024 registered with Dhantoli Police Station, Nagpur, for the 2026:BHC-NAG:12221

While granting bail, this Court imposed a condition that non-applicant No.1/accused shall not issue any threat or promise to any witness in any manner whatsoever, shall not tamper with the prosecution witnesses and shall not enter into the jurisdiction of Dhantoli Police Station. However, the non-applicant contravened the bail conditions imposed while granting bail. Hence, learned APP prays for cancellation of the bail. 5. Per contra, learned counsel appearing for the applicant canvassed that the applicant/informant amicably settled the dispute before the Mediator, and the informant and the main proceedings against the applicant/accused has been dropped. So also, on conclusion of the trial, non-applicant has not acquitted. 6. It is not in dispute that, by judgment and order dated 21/08/2026, the learned Adhoc District Judge-2 and Additional Sessions Judge, Nagpur, in Sessions Trial No. 120 of 2026, acquitted the non-applicant/accused in connection with Crime No. 383 of 2024 registered with Dhantoli Police Station. 7. Needless to say that, on 29/07/2026, this Court, passed an order in Criminal Application (Appln) No. 28 of 2026 holding that non-applicant/accused and the informant amicably settled the dispute as per the Mediation Report dated 16/07/2026, and accordingly, the said application came to be disposed off. 8. In view of the fact that the main trial has already culminated in the acquittal of non-applicant No.1/
