The challenge is to the amount recovered from the gratuity payable to the petitioner. 3. The said amount has been recovered by the respondent, saying that the amount was paid in excess to what was due to the petitioner. 4. Mr. M.I. Dhatrak, learned counsel appearing for the respondent, submits that in terms of the law laid down by the Supreme Court in the case of State of Punjab & Ors. v. Rafiq Masih (White Washer) & Ors., (2015) 4 SCC 334, the respondent is taking steps to return the amount so deducted. He submits that the amount of Rs. 1,25,748/- will be returned back to the petitioner within two weeks from today. 5. Statement is accepted. 6. The petitioner is satisfied with the development. 7. The petition is, accordingly, disposed of. 8. If the amount is not paid within two weeks from today, the petitioner will be entitled to revise the prayer.
