The gist of the case is that, during a Bihu function being held at Gelakey, some members of the ATTSA alongwith the present petitioner, who is the president thereof, were present, an altercation had taken place between two groups. When the police tried to intervene, the members of the group including the petitioner became aggressive towards the police and leveled allegations against the police and obstructed the police from doing their duty. The Case Diary as called for has been receiced. It appears that a notice under Section 35(3) of BNSS has also been issued to the present petitioner. But the learned counsel for the petitioner submits that the petitioner is apprehensive of arrest upon his appearance pursuant to such notice. Having regard to the nature of the allegations as well as the material available in the Case Diary, there appears to be no justification for taking the petitioner into custody in the event of his appearance before the I/O. Accordingly, the prayer for bail is allowed. The petitioner in the event of his arrest in connection with Gelakey P.S. Case No. 15/2026, registered under Sections 121/126/132/221/351(2)/189/353/3(5) of BNS, shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of like amount to
