JUSTICE S RACHAIAH - 3 - HC-KAR NC: 2026:KHC:13087 CRL.P No. 17729 of 2025 ORAL ORDER This petition is filed by the petitioners seeking anticipatory bail in Crime No.181/2025, registered by Madhugiri police station, Tumakuru for the offences punishable under Sections 115(2), 118(1), 109, 352, 3(5) Bharathiya Nyaya Sanhita (BNS), 2023. Brief facts of the case: 2. It is the case of prosecution that information has been lodged by the complainant stating that on 30.11.2025 about 06.30 a.m., Rathnamma was cleaning utensils in front of her house and she was throwing the water in front of the house of the Shravani. When the sister-in-law of the complainant asked Rathnamma as to why she was throwing the water in front of her house, Rathnamma started quarreling with Shravani and abused her in a filthy language. At that time, the husband of Shravani came and asked her as to why she was making galata and assaulting his wife. Immediately, the petitioner - 4 - HC-KAR NC: 2026:KHC:13087 CRL.P No. 17729 of 2025 - Siddagangaiah came outside from his house and dragged Shravani by holding her tuft and pushed her, as a result of which, the Shravani had sustained injuries on her head and back bone. The complainant had also been assaulted by the petitioner and others In the meantime, the villagers namely Gangaraju and Obalamma came and rescued them. The first informant and his wife took treatment in the Government Hospital. Thereafter, a complaint came to be registered. 3. Based on the said complaint, the respondent police registered a case in Cr.No.181/2025 and the matter is pending for consideration. The investigation is under progress. 4. Heard Sri. Venkatesha, learned counsel for the petitioners and Sri. B. Laxman, learned HCGP for the respondent State. - 5 - HC-KAR NC: 2026:KHC:13087 CRL.P No. 17729 of 2025 5. Learned counsel for the petitioners submits that sister-in-law of the first informant unnecessarily took quarrel with Ratnamma who is the wife of the 1st petitioner and they were quarreling with each other. The petitioners and others tried to pacify the said quarrel. However, a false case has been foisted against the petitioners and others, stating that they had assaulted the first informant and his wife Shravani. However, the said allegations are bald and baseless. In fact, a case and counter case are registered against each other. The medical report would indicate that the injuries sustained are simple and grievous in nature. The injured persons are out of danger. They have been discharged from the hospital after obtaining treatment. Therefore, the petitioners may be enlarged on anticipatory bail by imposing suitable conditions and they will abide by the conditions imposed by this Court in the event of their release on bail. Per contra, learned High Court Government Pleader for respondent-State vehemently submits that the petitioner No.1 being an elderly person, assaulted the sister-in-law of the first informant namely, Smt. Shravani W/o Bhoopala. Both the injured have sustained grievous injuries on their heads. The offence under Section 109 of BNS, 2023 is filed against them. As the petitioners have committed heinous offence, they are not entitled for anticipatory bail. If the anticipatory bail is granted, it would give wrong message to the society at large. Therefore, the petition has to be rejected. 7. Having heard learned counsel for the respective parties and on perusal of the averments of the complaint, it would indicate that the petitioners have committed heinous offences against the woman and her husband. The injured persons sustained injuries on the vital parts of the body. Though, they have taken treatment from the hospital and discharged, the fact remains that they are the - 7 - HC-KAR NC: 2026:KHC:13087 CRL.P No. 17729 of 2025 residents of same locality. In order to secure the confidence and faith of the injured, it is appropriate to reject the petition. Hence, I proceed to pass the following: ORDER i) The criminal petition stands rejected. ii) The liberty is reserved to the petitioners to file necessary application for bail after surrendering before the said Court. If such application is filed, the trial Court is directed to consider the said application on the same day and pass appropriate order in accordance with law.
