The petitioner has been made accused in connection Peterwar P.S. Case No.107 of 2024 registered for the offences punishable under Section 341, 323, 307, 379, 447 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons, has attempted to murder Suresh Prasad Nayak by inflicting axe-blow on his head. It is submitted that the allegation against the petitioner is false. It is next submitted that in fact, the informant was the aggressor party. It is next submitted that for the self-same occurrence from the side of the petitioner, the son of the petitioner lodged Peterwar P.S. Case No.72 of 2024 and to wreak vengeance, the informant lodged Complaint Case No.482 of 2024 belatedly on 21.05.2024 which upon being referred to police under Section 156 (3) of Cr.P.C., the F.I.R. of this case has been registered. It is also submitted that the co-accused Anita Devi has already been given the privileges of anticipatory bail by a co-ordinate Bench of this Court vide order dated 30.06.2025 passed in A.B.A. No.3410 of 2025. It is then submitted that the petitioner undertakes that she will co-operate with the trial of the case and that she will not annoy or disturb the informant or any of his family members in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 07.10.2025 as is evident from para-06 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat in connection with Peterwar P.S. Case No.107 of 2024 with the condition that she will co-operate with the trial of the case, furnish her mobile number and photocopy of the Aadhar Card in the court below with an undertaking that she will not change her mobile number during the trial of the case and will not annoy or disturb the informant or any of his family members in any manner during the trial of the case.
