ORDER: (Per Hon’ble Sri Justice D.Ramesh)
The present Civil Revision Petition is filed assailing the order dated 30.12.2024 passed in E.P.No.28 of 2022 on the file of the Court of the II Additional District Judge, Hindupur, Ananthapuram District, arising out of the arbitral award passed in A.A.No.1396 of 2013.
2. When the matter was taken up on 12.08.2026, this Court recorded the submission made by the learned counsel for the petitioners and adjourned the matter to enable the learned counsel for the respondent to obtain instructions.
3. Today, learned counsel for the respondent, on instructions, submitted that the respondent has already received part of the decretal amount and has no objection for the petitioners paying the balance amount in installments, as proposed by them.
4. In view of the consensus arrived at between the parties and without expressing any opinion on the merits of the matter, the order dated 30.12.2024 passed in E.P.No.28 of 2022 by the learned II Additional District Judge, Hindupur, is set aside. The petitioners are directed to pay the balance amount due under the award in six (06) equal monthly installments, commencing from the date of receipt of a copy of this order.
5. It is made clear that, in the event of default in payment of any one of the installments, this order shall stand automatically vacated and the order passed in E.P.No.28 of 2022 shall revive and would be in force in accordance with law.
6. Accordingly, the Civil Revision Petition is allowed in the above terms. There shall be no order as to costs.
As a sequel, all miscellaneous applications, if any, pending in this Petition shall stand closed. ____________ D.RAMESH, J
