JUSTICE PARTHIVJYOTI SAIKIA O R D E R 19.06.2026 Heard Mr. M. Biswas, the learned counsel appearing for the petitioners. Also heard Mr. P. Borthakur, the learned Addl. Public Prosecutor, Assam. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioners namely- Sri Shakti Kumar @ Shakti Kumar Jha, aged about 64 years and his wife Smti. Kiran Jha, aged about 58 years have prayed for releasing them on bail after they were arrested in connection with Jalukbari P.S. Case No.119/2026. 3. Shri Saurav Kumar Jha is the son of the petitioners and he is a Real Estate agent. Saurav Kumar Jha showed different properties at Guwahati city to the informant T.L. Rajkumar, who hails from the State of Arunachal Pradesh and he wanted to buy properties at Guwahati. T.L. Rajkumar is a veteran politician from the State of Arunachal Pradesh. 4. An undisclosed amount of money was paid by T.L. Rajkumar to Saurav Kumar Jha for buying property at Guwahati. In spite of that, T.L. Rajkumar failed to buy any property at Guwahati. He claims that the present petitioners being the parents of Saurav Kumar Jha have conspired with their son to cheat him of his money. The informant has further alleged that with his money they have procured and constructed properties at Guwahati and in other places, like Bihar and West Bengal. 5. It may be mentioned that Saurav Kumar Jha is on the run. Page No.# 3/3 6. Police arrested the present two petitioners on the basis of the aforesaid allegations. 7. The petitioners have submitted that they have nothing to do with the acts of their eldest son Saurav Kumar Jha. By swearing an affidavit, Shakti Kumar Jha has disowned his son Saurav Kumar Jha. Both the petitioners have submitted that they are not connected with the acts of their son Saurav Kumar Jha. 8. I have considered the submissions made by the learned counsels of both sides. 9. There is no doubt that the allegation of criminal misconduct is against Saurav Kumar Jha. This Court is of the opinion that there are no materials to suggest that these two petitioners had any connections with the acts of their son. Therefore, the two petitioners do not deserve to be detained in custody for any further period of time. Their bail application is allowed. 10. The petitioners namely- Sri Shakti Kumar @ Shakti Kumar Jha, and his wife Smti. Kiran Jha who were arrested in connection with Jalukbari P.S. Case No.119/2026, shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup(M) at Guwahati.
