Learned Additional Government Advocate accepts notice for respondent No.1. 2. Sri. B.S.Ravindra Prasad, learned counsel is directed to accept notice for respondent No.2. 3. Petitioners are before this Court seeking for the following reliefs: a. Writ of Mandamus directing the 2nd respondent to consider the representation dated 05.07.2023 at Annexure-C. b. Writ of Mandamus direct the 2nd respondent to effect the Khata in favour of the petitioners with respect to Khata bearing No.1167 (Old No.1181) measuring to the extent of East to West 70 feet and North to South 115 situated - 3 - HC-KAR NC: 2026:KHC:10955 WP No. 5887 of 2026 at Market Road, T. Narasipura and mention the Khata details in the register named as K.M.V.24. c. Grant such other reliefs or reliefs as this Honorable Court be thinks fit in the circumstances of the case, in the interest of justice and equity 4. The petitioners claim that the property bearing Khata No.1167 (old No.1181) situated at Market Road (Link Road), T.Narasipura, originally belonged to one Srinivas Iyengar, the same being an ancestral property and the partition being affected. The property came to the share of one Jayagopal, who is the father of petitioner Nos.1 and 3 and husband of petitioner No. 2. The said father having expired on 17.06.1999, the petitioners had made an application to get the Khata in their name on 05.07.2023, which has not been considered by the respondents till date. It is in that background that the petitioners are before this Court seeking for the aforesaid reliefs. 5. Whenever any application is filed for issuance of Khata or change of Khata, the same is required to be considered and necessary orders to be passed within the time frame prescribed under the Karnataka Sakala Services Act, 2011, and (Amendment) Act, 2014. In the present case, - 4 - HC-KAR NC: 2026:KHC:10955 WP No. 5887 of 2026 the application having been filed in the year 2023, the said application has neither been accepted nor rejected. In that view of the matter, I pass the following: ORDER i) Writ petition is allowed. ii) A mandamus is issued, directing respondent No.2 to consider the representation dated 05.07.2023 at Annexure-C and pass necessary orders within a period of sixty days from the date of receipt of a copy of this order. iii) It is made cleat that this Court has not expressed any opinion on the entitlement of the petitioner. ` SD/- (SURAJ GOVINDARAJ) JUDGE GJM List No.: 2 Sl No.: 22
