19.06. 2026 Heard Mr. R. M. Deka learned counsel for the petitioner. Also heard Mr. D. Upamanyu, learned Standing Counsel, Health. 2. This present writ petition has been filed by the petitioner, who is presently serving as In-charge Deputy Director of Health Services (HEB) under the Government of Assam. The petitioner’s claim is that he should be considered for promotion and appointed to the post of Deputy Director on a regular basis. The petitioner submitted representation before the Commissioner & Secretary, Government of Assam on 31.12.2024 which is presently pending. Being aggrieved, the petitioner is before this Court. 3. It is the submission of the learned counsel for the petitioner that this representation remained unattended and no orders have been passed thereon; and if any order has been passed, then the same has not been served upon the writ petitioner. 4. The limiter prayer of the petitioner before this Court is that a direction
Page No.# 3/4 should be issued to the Commissioner & Secretary, Department of Health, Government of Assam to consider and dispose of the representation filed by the petitioner, which was forwarded to the office of the Principal Private Secretary to the Chief Minister vide communication dated 14th February, 2025. It is submitted that the said representation be considered and disposed of by passing a speaking order. 5. Mr. D. Upamanyu, learned Standing Counsel does not object to the prayer made. 6.
From the enclosure to the writ petition it is seen that the said representation stated to be filed by the petitioner was forwarded to the Office of the Commissioner & Secretary, Government of Assam, Department of Health and Family Welfare Department on 14th February, 2025, which appears to have been received 19.02.2025. 7. Accordingly, this writ petition stands closed, directing the Commissioner & Secretary, Government of Assam, Department of Health and Family Welfare to consider the representation filed by the petitioner and pass appropriate speaking orders on the said representation filed by the petitioner. 8. Needless to say, when such an order is passed, copies thereof will be
Page No.# 4/4 served upon the writ petitioner. In the event, any order has already been passed; copies thereof shall be served upon the writ petitioner without further delay. 9. Let this exercise be completed within a period of 60 days from the date of receipt of certified copy of this order. 10. Accordingly, this writ petition disposed of in terms of the above.
