The Petitioner has approached this Court for grant of regular bail in connection with Gamharia P.S. Case No. 26 of 2025, registered for the offence under Sections 103(1) and 238(a) of B.N.S, pending in the Court of Chief Judicial Magistrate, Seraikella.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that there is no evidence to establish that the petitioner was in any manner involved in commission of alleged occurrence and nothing incriminating has been recovered from the conscious possession of this petitioner. He further submits that the petitioner is languishing in custody since 07.06.2025; as such, the petitioner may be enlarged on bail.

Learned A.P.P opposes the prayer for bail of the petitioner and submits that there is direct and specific allegation against this petitioner; as such, he does not deserve grant of regular bail.
5. Having regard to the allegation made against the petitioner as well as gravity of the offence, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, his prayer for bail is rejected.
