Case No. 65 of 2022 for the offence registered under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 66(C), (D) of the Information Technology Act, pending in the Court of learned Special Judge, Cyber Crime, Jamtara, is pressed into motion. As per the FIR, the main allegation against the petitioner is that by posing himself as CID Inspector, and sending notice by e-mail he attempted to commit cybercrime. It is submitted by the learned Council on behalf of the petitioner that no victim has been cited in the FIR. No offence was committed under the provisions of BNS, 2023. The provisions under Section 66(B)(C) (D) of the Information Technology Act are bailable in nature. There is no material save and except the confessional statement of co-accused. Learned A.P.P. opposed the bail petition. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) and Rs 10,000/- security deposit, with two sureties of the like amount each to the satisfaction of the Court below.
