Despite   service   of   notice,   no   one   has appeared   on   behalf   of   the   respondent,   before   this   Court. Further, wait is not justifiable. As such, the present petition is being decided. 2. Petitioner–Neeta Devi has approached this Court, by way of the present petition, under Section 24 of the Code of 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:9415 Civil Procedure (hereinafter referred to as ‘the CPC’), with a prayer to transfer of HMA Petition No.214 of 2025, titled as Vinod Kumar versus Neeta Devi, instituted by the respondent­ husband before the Court of learned Principal Judge Family Court, Nurpur, District Kangra  to Principal Judge, Family Court, Chamba, H.P. 3. According to the petitioner­wife, she was married to respondent­husband, on 31.07.2024. After the marriage, she has started residing with the respondent­husband and his family,   but,   she   was   subjected   to   continuous   mental   and physical harassment by the respondent­husband, as well as, his family members. She was allegedly tortured for dowry and the   respondent­husband   even   resorted   to   physical   assault. Thereafter, she was compelled to leave the matrimonial home, in the month of April, 2025. 4. Subsequently, respondent­husband  filed petition, under   Section   9   of   the   Hindu   Marriage   Act   (hereinafter referred to as ‘the Act’), bearing HMA Petition No.214 of 2025, before the Principal Judge, Family Court (Additional District Judge), Nurpur, District Kangra. 3 2026:HHC:9415 5. According   to   the   petitioner,   she   is   residing   in village   Bhadol,   Post   Office   Dand,   Tehsil   Salooni,   District Chamba and is compelled to visit the Court at Nurpur, which, according   to   her,   is   situated   at   a   distance   of   about   60 kilometers. 6. Asserting the fact that she is residing with her parents in a remote village, where, she has to walk about six kilometers to reach the motorable road and also asserting the fact that she has no income, as she is residing with her aged mother,   younger   brother   and   her   father,   according   to   the petitioner­wife, she has no financial support to contest the said petition. 7. On the basis of the above facts, a prayer has been made to allow the petition. 8. Along with the present petition, the petitioner­wife has   annexed   the   photocopy   of   the   petition,   filed   by   the respondent­husband,   under   Section   9   of   the   Act. Despite service of notice, respondent­husband has not bothered to put appearance   before   this  Court   to   controvert  the   allegations, which have been levelled in the transfer application. Meaning 4 2026:HHC:9415 thereby, whatsoever asserted by the petitioner­wife, which is duly supported by the affidavit, has not been controverted by the respondent­husband. 9. A poor lady cannot be compelled to contest the litigation,   which   has   been   filed   for   restitution   of   conjugal rights, that too, at a far away place i.e., Nurpur, as according to   her,   she   is   having   no   source   of   income   and   is   fully dependent upon her mother, brother and aged father. 10. Considering the said fact that the convenience of the wife is paramount consideration, in such type of matters, this Court is of the view that the present petition is liable to be allowed. 11. Consequently, the petition is allowed and the case bearing  HMA   Petition   No.214   of   2025,   titled   as  Vinod Kumar  versus  Neeta Devi, pending adjudication before the Court of learned Principal Judge, Family Court, Nurpur is transferred to the Court of learned Principal Judge, Family Court, Chamba, District Chamba, H.P. 5 2026:HHC:9415 12. Learned Principal Judge, Family Court, Chamba, District Chamba, H.P., is requested to proceed further, after securing the presence of both the parties. 13. Pending miscellaneous application(s), if any, shall also stand disposed of. 14. A copy of this order be sent to the Court of learned Principal Judge, Family Court, Nurpur, District Kangra, as well as, to the Court of learned Principal Judge, Family Court, Chamba, District Chamba, H.P., for compliance.
