The petitioner is apprehending his arrest in connection with Complaint Case No.352 of 2025, for offence registered under section 33(1)(C), 41, 42 IPC and section 27 and 29 of Wildlife Protection Act, pending in court of learned Chief Judicial Magistrate, Chatra. 3. Learned counsel for petitioner submits that false allegations are made of cultivation of poppy plant in forest area and land is not belonging to the petitioner and petitioner has got no criminal antecedent as disclosed in para 17. 4. Learned State counsel opposes prayer and submits that allegation of cultivation of poppy plant in forest area is there. 5. Considering that land is of the forest department and the same is not belonging to the petitioner and the petitioner has 2026:JHHC:695 2 got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complaint Case No.352 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
