The Court made the following order:
Learned Counsel for the petitioner submits that the petitioner is aggrieved by issuance of the impugned proceedings dated 24.07.2026 issued by the 4th respondent. It is submitted that the petitioner is in possession and enjoyment of agricultural land admeasuring Ac.0.87 cents, situated in Survey No. 328-2 of Gopavaram Village, Musunuru Mandal, Eluru District. 2.
It is submitted that, initially, the subject property was jointly held by the petitioner and his brother. Subsequently, the rights over the said property were transferred by the petitioner’s brother in favour of the petitioner. 3. It is submitted that the same was considered by the then Tahsildar vide proceedings dated 25.03.2005 and reassignment proceedings were issued. Pattadar pass book and title deed was also issued in the name of the petitioner, and the name of the petitioner was reflected in the 1B in respect of the subject property. 4. It is submitted that the revenue records erroneously entered the name of the petitioner’s grandson and aggrieved by the same, the petitioner submitted representation to the 3rd respondent seeking rectification of the records. The 3rd respondent issued instructions to the 4th respondent on 05.05.2026 to rectify the entries in the web portal by reflecting the petitioner’s name. 4
5. It is submitted that the 4th respondent instead of complying the said directions, has issued impugned proceedings, which run contrary to the instructions of the 3rd respondent. 6. The learned Assistant Government Pleader appearing for the respondents does not dispute the proceedings issued by the 3rd respondent. However, he submits that the impugned proceedings were issued by the 4th respondent by following due process of law. 7. Considering the submissions, the Writ Petition can be disposed of by setting aside the impugned proceedings, as the said proceedings do not refer to the proceedings of the 3rd respondent dated 05.05.2026, which specifically require the 4th respondent to restore R.S.No.328-2 as reflected in the web plan prior to the resurvey. The impugned proceedings do not refer to the proceedings of the 3rd respondent dated 05.05.2026. 8. In view of the above, the impugned proceedings issued by the 4th respondent are hereby set aside. The 4th respondent is directed to pass orders afresh by duly taking into consideration the proceedings of the 3rd respondent dated 05.05.2026 in accordance with law. 9.
Accordingly, the Writ Petition is allowed. There shall be no order as to costs. 5
