Said H.M.O.P was filed by both husband and wife under Section 13(B) of Hindu Marriage Act, 1955. While considering the matter, the 2nd petitioner therein being wife has opposed and contended that she has not given any consent for mutual divorce. Aggrieved by the same, the present Civil Miscellaneous Appeal has been filed by the husband. Notice has been ordered to the appellant through Registry as learned counsel appeared on behalf of the appellant is no more. Notice was received by the appellant but he did not choose to appear before this Court either in person or by engaging a counsel. Hence the appeal is dismissed for non-prosecution. No costs.
