No.18932 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India, to issue order or orders, direction or directions, writ, particularly one in the nature writ of Mandamus, or any appropriate writ, declaring the action of the respondents in not paying the bills for execution of works vide 1) Agreement No.46KW of 2024-25, dt.23-07-2024, 2) Agreement No.25 of 2023-24, dt.29-06-2023, 3) Agreement No.29 of 2024-25, dt.31-07-2024 4) Agreement No.30 of 2024-25, dt.31-07-2024, 5) Agreement No.37 of 2021-22, dt.25- 08-2021, 6) Agreement No.38 of 2021-22, dt.25-08-2021, 7) Agreement No.39 of 2021-22, dt.25-08-2021 awarded by the respondent No. 6 for total amount of Rs.37,65,0561- to the petitioner with 6% interest from the date of completion of respective works till today as illegal, arbitrary, violation of the principles of natural justice and violative of Articles 14, 19 (i) (g) ,21 of the Constitution of India; and consequently direct the respondents to release the bills for the above completed works immediately with 6 percent interest and to pass such other order as this Court deems fit and proper. 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 03. On the other hand, learned Assistant Government Pleader for Irrigation, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the Executive 3 W.P. No.18932 of 2026 Engineer, K.W. Division, Tenali, dated 15.08.2026 stating that the bill for an amount of Rs. 3,66,127/- could not be uploaded in NIDHI portal due to non-release of LOC to the required extent. He further placed on record a copy of written instructions of the Executive Engineer, Drainage Division, stating that bill for an amount of Rs.29,32,188/- could not be uploaded in NIDHI portal due to non- release of LOC to the required extent. 04. In view of the submissions made on both sides, the writ petition is allowed, directing the respondents to release the admitted amount of Rs. 32,98,315/- (thirty two lakh ninty eight thousand three hundred fifteen rupees only) to the petitioner, along with the interest as per the entitlement, if any, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. There shall be no order as to costs.
