Mr. Rameshwar Sinha … for the petitioner This is an application wherein petitioner has prayed for a direction upon the Court below for expeditious disposal of G.R. Case No.3109 of 2023 presently pending before learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur. Learned Counsel for the petitioner submits that the charge-sheet was submitted in this case on 13.11.2019 and charge was also framed in the year 2020 but since then only two witnesses have been examined so far out of 8 witnesses and the case is pending for a considerable period of time before the Court below. Having heard learned Counsel for the petitioner it appears that if the instant Application is disposed of in terms of the prayer made in the petition, opposite party will have no cause to prejudice and therefore, service of copy of application upon the opposite parties are hereby dispensed with. Since the prayer made by the petitioner is justified in terms of long pendency of the case, I find that the prayer made by the petitioner is required to be allowed for the ends of justice and therefore invoking this Court’s jurisdiction under Section 529 of the BNSS, the instant Application being CRR 2224 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the case and to make his best effort to conclude the entire 2 proceeding preferably within a period of six months from the next date of hearing.
