B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH ORDER 17.06.2026
The petitioner herein has sought for a direction upon the respondents for providing the petitioner a certified copy of the required Vendyke Map for the year 1961-62, along with the latest one in respect to village Chakirchar under South Salmara Revenue Circle in the district of Dhubri.
2. This Court duly enquired as to why the petitioner seeks the copy of the Vendyke Map. The learned counsel submitted that the same is required in connection with Title Suit No.218/2025 so that the petitioner would be in a
Page No.# 3/3 position to prove his case.
3. It is very pertinent to observe that the Writ Court is not a Court wherein the jurisdiction can be exercised in such a manner, that too, when the petitioner can very well file appropriate applications before the Civil Court for calling for the Vendyke Map, and the Civil Court duly has the jurisdiction to consider the necessity of the said evidence and, thereupon, pass appropriate directions.
4. Under such circumstances, this Court is not inclined to entertain the instant writ petition, for which, the writ petition stands dismissed.
