Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 25 Kgs. of Ganja and the petitioner is in custody from 09.05.2025, charges have already been framed and there is no possibility of the trial concluding very soon, as such the petitioner may be released on bail.
Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the relevant materials collected in course of investigation.
Learned advocate appearing for the petitioner has also drawn the attention of the Court to CRM (NDPS) 1162 of 2025 wherein this Court was pleased to allow the prayer for bail of
2 the co-accused. Petitioner is similarly situated as the other co- accused who has been granted bail.
Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 145 of 2026 is allowed. Petitioner, namely, Sudan Roy shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act) – cum – Learned Additional District and Sessions Judge, 6th Court, North 24 Parganas.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Trial Court.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
