This is an application under Section 483 of BNSS, 2023 seeking bail. Page No.# 2/3 The allegations as reflected in the FIR is that, about six months prior to lodging of the FIR, the victim aged about 17 years 10 months eloped with the accused/petitioner and she was staying with the petitioner as his wife. Subsequently, on 05.04.2026 during morning hours, the accused allegedly caused the death of the victim by strangulation and thereafter, attempted to portray the incident as a case of suicide committed by the victim. The Case Diary alongwith medical report as called for has been received. As per the medical report, final report regarding cause of death has been kept pending due to non receipt of report from FSL. However, from the post- mortem report, it appears that an oblique non-continuous ligature mark was found high up on the neck of the victim which is primarily indicative of suicidal hanging. Having regard to the above as well as the period of detention of 75 days, further detention of the petitioner may not be necessary. Accordingly, the prayer for bail is allowed. The petitioner in the event of his arrest in connection with Nalbari P.S. Case No. 58/2026, registered under Section 103(1) of BNS, shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of like amount to the satisfaction of the concerned Trial Court. It is further provided that the petitioner shall corporate with the Page No.# 3/3 investigation and shall not try to influence the witnesses in any manner. The petition stands disposed of.
