The petitioner alleges that the private respondents have raised construction by encroaching upon his land without obtaining any sanctioned building plan from the concerned authority. Learned counsel for the State as well as the private respondents submit that construction raised by the private respondents is under the Pradhan Mantri Awas Yojana Scheme. No sanction is required for such construction. Since the petitioner alleges that the private respondent have encroached upon his land in raising the two storied construction, he is at liberty to approach the appropriate civil forum for redressal of his grievance. The writ petition is disposed of. There shall be no order as to costs. 2 Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
