The petitioner is seeking regular bail in connection with Kamdara P.S. Case No. 48 of 2025, registered under section 376 of I.P.C, pending in the Court of learned Addl. Chief Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner for establishing physical relationship with the victim. He next submits that victim is a major lady and allegation is made that physical relationship was being established from the year, 2022 however F.I.R has been lodged on 08.09.2025. He also submits that petitioner is in custody since 18.09.2025. 4. Learned counsel for the State opposes the prayer and submits that allegation of establishing physical relationship is there. 5. From the contents of F.I.R. it transpires that allegation is made against the petitioner for establishing physical relationship with ( 2026:JHHC:623 ) 2 the victim from the year, 2022 however F.I.R has been lodged on 08.09.2025. The petitioner is in custody since 18.09.2025. The victim is a major lady and prima facie what has happened that is consensual in nature and in the attending facts and circumstances of the case, I am inclined to grant regular bail to the petitioner. Accordingly, the petitioner, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Addl.
