The State of West Bengal Mr. Mrityunjoy Chatterjee …for the Petitioner This is an application wherein the petitioner has prayed for stay of the impugned order dated 13th January, 2025 by which, the court below had issued warrant of arrest against the present petitioner. Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the petitioner initially preferred a revisional application being CRR 1507 of 2001 and by an order dated 6th July, 2001, this court granted stay of all further proceedings for a period of six weeks and thereafter, by another order dated 10th August, 2001, the interim order was ordered to be continued till disposal of the revisional application. However, the said revisional application was dismissed for default for not taking steps by an order dated 2nd July, 2019 and thereby the interim order was vacated. Thereafter, the court below issued warrant of arrest against the present petitioner who was not aware about the latest development of the case before the High Court. Now he wants to surrender and accordingly, prays for granting leave. 2 Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed, the opposite party will have no cause to prejudice, the service of copy of the application upon the opposite party are dispensed with. In view of the aforesaid submission made on behalf of petitioner, CRR 195 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of two weeks and in the event such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein. The impugned order dated 13.1.2025 which pertains to the issuance of warrant of arrest against the petitioner, is hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier.
