It is of course argued by learned counsel for the petitioner- Bengu Khila @ Khala to grant him bail since he was extended with the benefit of bail by an order dated 16.01.2024 passed in ABLAPL No. 14318 of 2023 to grant him bail on his surrender, but when this Court on perusal of such order does not find any discussion with regard to satisfaction of conditions of Sec. 37 of NDPS Act and confronted the learned counsel for the petitioner- Bengu Khila @ Khala about the law laid down by Apex Court in Satpal Singh vrs. State of Punjab; (2018) 13 SCC 813, Mr.Jugala Kishore Panda, learned counsel for the petitioner in BLAPL No. 723 of 2026 seeks permission of the Court to withdraw the present bail application by praying to grant liberty to the petitioner to move the learned Court in seisin over the case afresh. Accordingly, the bail application of the petitioner- Bengu Khila @ Khala in BLAPL No. 723 of 2026 stands disposed of as withdrawn with aforesaid liberty as prayed for. 3. Further, Mr.Rajib Lochan Pattnaik, leaned counsel for the petitioner in BLAPL No. 13096 of 2025 and Mr.Pranab Kumar Das, learned counsel for the petitioner in BLAPL No. 13106 of 2025 jointly seek permission of the Court to withdraw these two bail applications.
